Diritto al computer
Il titolo è provocatorio ma non lungi dalla realtà.
Recentemente una sentenza della Corte di Cassazione* sembrerebbe essere giunta a questa conclusione.
Prima di gridare allo scandalo esaminiamo sinteticamente il caso da cui è scaturita la pronuncia in discorso.
La situazione è nota: dopo la separazione il marito deve versare una somma di denaro a titolo di mantenimento per il figlio e la moglie. A cagione dell'inadempimento del coniuge la donna agisce in sede penale per violazione degli obblighi di assistenza familiare ( art 570 cp )
Prescindendo in questa sede da discorsi segnatamente giuridici e poco comprensibili al lettore comune, preme sottolineare come la Suprema Corte divisi che, nella nozione penalistica di mezzi di sussistenza, debbano essere ricompresi tutti gli strumenti finalizzati al soddisfacimento delle altre complementari esigenze della vita quotidiana . I Sommi Giudici citano a livello esemplificativo l'abbigliamento, i libri di istruzione per i children, transportation and, unbelievable, media . Here is a passage from the decision:
[...] It is fitting, on the other side, and conversely, to reiterate that criminal law the concept of livelihood called art. Cp 570, paragraph 2, no 2 [...] should - in the current dynamic of the evolution of the structure and habits of family and social life - and no longer regarded as including not only the means for survival of life (such as food and housing), but also the tools to albeit a content satisfying other additional requirements of daily life (eg clothing, books, education for children, transportation, media). [...]
apparent then a question of interpretation of no small importance: between the notes the media covered the "right to phone" or the "right to your computer " and why not, the "right Internet ?
Apart from this strictly legal considerations regarding the qualification of the case raises a question.
In the computerized society is really weird claim an elusive right to your PC or you're losing a sense of proportion blacken it by degeneracy in what some call "hedonistic drift"? Each
draw their own conclusions.
